1. Acceptance of Terms
By engaging with WebX’s services, including but not limited to purchasing a web design package, utilizing our hosting services, or accessing any content provided by WebX, you acknowledge that you have read, understood, and agree to adhere to these Terms of Use in their entirety. If you do not agree with any part of these terms, you must not use our services.
2. Description of WebX Service
WebX is an online platform that specializes in providing high-quality, custom-designed websites at competitive prices and with fast delivery times, typically within 3 working days for the first draft. Our service includes web design, copywriting, development, and hosting, aimed at making website creation easier than traditional methods or DIY builders. We are not a DIY website builder software; rather, we provide a done-for-you service.
3. Ownership and Usage Rights
Upon delivery and full payment of your website, all content, including text, images, and other media provided by you or created by WebX on your behalf, becomes the property of the Customer. Customers are granted full usage rights and are free to modify, update, or manage the content on their website as they see fit through the provided content editor and backend access.
4. Blocked Website Categories
WebX reserves the right to deny service, terminate existing services, and/or refund any orders that fall within categories we are unable to serve. This policy is in place to maintain the integrity and safety of our platform and community. Prohibited website categories include, but are not limited to:
Adult Themes: Content involving nudity, explicit sexual material, excessive violence, promotion of self-harm, or smoking-related content.
Illegal Industries: Any themes, content, or services associated with illegal activities as per Malaysian law and international regulations.
Political Themes: Content primarily aimed at driving a political agenda for any party, candidate, or country.
Religious Themes: Websites for places of worship, or content primarily focused on promoting specific religious celebrations/events, or religious doctrines.
Hate Speech/Discriminatory Content: Any content that promotes discrimination, hatred, or violence against any group or individual based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic.
Malware/Phishing: Websites designed to distribute malware, engage in phishing attempts, or other malicious activities.
5. Fair Use Policy for Hosting & Resources
WebX provides free server hosting as part of your active subscription. To ensure stable and reliable service for all our customers, we implement a Fair Use Policy:
Storage Space: Each website is allocated up to 500MB of storage space. This limit is generally sufficient for standard business and personal websites as per our packages. Should your website require additional storage, please contact our support team for upgrade options.
CPU and Bandwidth: While WebX does not impose strict hard limits on CPU or bandwidth usage for individual sites, our services are intended for normal and reasonable website operations. We reserve the right to restrict, limit, or take down any site if its resource consumption becomes excessively high, impacts the performance or stability of our servers, or negatively affects other users. This includes, but is not limited to, cases of:
Distributed Denial of Service (DDoS) attacks.
Malicious attacks or abnormal traffic spikes.
Use of the service for file storage/sharing unrelated to the website’s primary function.
Operating as a proxy server, IRC bot, or other resource-intensive applications.
Excessive use of server resources due to inefficient code or unoptimized content.
Should your website consistently exceed reasonable resource consumption, we may require you to upgrade your plan, optimize your content, or in severe cases, we reserve the right to suspend or terminate your service to protect the overall system integrity. We will endeavor to notify you in advance of any such action, where practicable.
6. Support and Maintenance
WebX offers dedicated support and maintenance services to assist customers with technical issues, updates, or modifications. While basic support is included with your active subscription, certain advanced or extensive services may be separately charged. Customers can opt for ongoing support arrangements beyond the initial delivery to address specific needs.
7. Pricing, Packages, and Payments
All pricing, features, and inclusions for each web design package are clearly outlined on our pricing page before purchase. Additional features, custom modifications, or services beyond the scope of your purchased package may incur additional charges, which will be communicated and agreed upon prior to implementation. All payments for WebX services are processed upfront.
8. Communication and Feedback
WebX encourages open and constructive communication with our Customers throughout the design and development process. We highly value your feedback and input, which will be considered during various stages to ensure your satisfaction with the final product. Delays in providing timely feedback may impact the delivery timeline.
9. Refunds and Cancellations
All sales on WebX are final, non-transferrable, and non-refundable. Due to the custom design and rapid delivery nature of our service, we do not offer refunds once an order has been placed and work has commenced. You may cancel your yearly subscription at any time; however, no refunds will be provided for the current subscription period.
10. Data Deletion
Should you wish to have your website data deleted from our servers, simply open a support ticket or contact us via email at [email protected] with your request. We will process your data deletion request promptly in accordance with our data retention policies and applicable privacy laws. Please note that once data is deleted, it cannot be recovered.
11. Uptime and Service Availability
WebX strives to ensure maximum uptime and availability of our hosting services. However, we do not guarantee 100% uninterrupted service. Occasional downtime may occur due to scheduled maintenance, unforeseen technical issues, or circumstances beyond our reasonable control. We will endeavor to provide advance notice for any planned maintenance.
12. Backups
WebX performs daily backups of your website data to minimize data loss. While we take reasonable measures to ensure data integrity, it is ultimately the Customer’s responsibility to maintain their own backups of their website content. WebX shall not be held liable for any data loss.
13. Limitation of Liability
To the fullest extent permitted by law, WebX (Pixl Digital) shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information, or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; or (v) any other matter relating to the service.
14. Indemnification
You agree to indemnify, defend, and hold harmless WebX (Pixl Digital), its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the services, your violation of these Terms of Use, or your infringement of any intellectual property or other right of any third party.
15. Modifications to Terms
WebX reserves the right to modify or update these Terms of Use at any time, with or without prior notice. Any changes will be effective immediately upon posting the revised Terms of Use on our website. Your continued use of the services after any such changes constitutes your acceptance of the new Terms of Use. It is your responsibility to review these Terms periodically for any updates.
16. Governing Law and Dispute Resolution
These Terms of Use shall be governed by and construed in accordance with the laws of Malaysia. Any dispute, controversy, or claim arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by arbitration in Malaysia in accordance with the rules of the Asian International Arbitration Centre (AIAC).
